By agreeing to the following terms and conditions, I acknowledge that I am requesting access to my patients' clinical reports and other protected health information and the ability to communicate with Baylor Miraca Genetics Laboratories ("BMGL") concerning my patients' clinical information via the Internet using an electronic application called GeneResults®.

• I understand that GeneResults® is intended as a secure online source of confidential medical information. I must have internet access and my computer's internet browser must be either Mozilla Firefox, Safari 6 or newer, Chrome or IE 8 or newer.
• I understand that GeneResults® is never to be used as a means of communication to "BMGL" for urgent or emergency matters.
• I understand that BMGL is capable of sending me e-mail messages notifying me that I have a patient report ready for pickup via GeneResults®. I have the option of entering a valid and functional email address that may be used to notify me of the presence of GeneResults® messages. If I opt to provide this email address for notification of the presence of GeneResults® messages, I will update my email address on GeneResults® when my email address changes.
• These messages will not contain any protected health information. It is my responsibility to monitor these messages and review my reports. I agree not to hold BMGL liable for any loss, injury or claims of any kind resulting from GeneResults® messages that I fail to read in a timely manner.
• I have the option of assigning delegates that are authorized to access my patients' information and reports in GeneResults®. I agree not to hold BMGL or Baylor College of Medicine liable for any loss, injury or claims of any kind resulting from my delegations.
• I agree that it is my responsibility to select a confidential password, to maintain my password in a secure manner, and to change my password if I believe it may have been compromised in any way. If I share my GeneResults® ID and password with another person, that person will be able to view my patients' demographics and clinical reports, and information about any other healthcare provider who has authorized me as a GeneResults® proxy. I agree not to hold BMGL liable for any loss, injury or claims of any kind resulting from my disclosure of the confidential password or confidential information on GeneResults®.
• I understand that my activities within GeneResults® may be tracked by computer audit and that entries I make may become part of the electronic record.
• I understand that access to GeneResults® is provided by BMGL as a convenience to me and that BMGL has the right to deactivate access to GeneResults® at any time for any reason or no reason without notice to me. I understand that use of GeneResults® is voluntary and I am not required to use GeneResults® or to authorize a GeneResults® proxy.

• I understand that GeneResults® may not be available to me all the time due to system failures, back-up procedures, maintenance, or other causes beyond the control of BMGL. Access is provided on an "as-is, as-available" basis and does not guarantee that I will be able to access GeneResults® at any particular time.
• I UNDERSTAND THAT Baylor Miraca Genetics Laboratories TAKES NO RESPONSIBILITY FOR AND DISCLAIM ANY AND ALL LIABILITY ARISING FROM ANY SOFTWARE INACCURACIES OR SOFTWARE DEFECTS, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR MY INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT I USE TO ACCESS GeneResults®.
• During times when GeneResults® is unavailable, other communication methods (e.g., fax/secure message) will be used to distribute patient reports.
